Learned counsel for the petitioner submits that the petitioner is in custody since 24.07.2025 in connection with Jirwabari P.S. Case No. 146 of 2025 corresponding to POCSO Case No. 59 of 2025, registered under Section 65(1) of the Bharatiya Nyaya Sanhita, 2023 and section 4 of Protection of Children from Sexual Offences Act, 2012, now pending in the court of learned Additional Sessions Judge- I, Sahibganj-cum- Special Judge (POCSO Act), Sahibganj. 3. Learned counsel for the petitioner further submits that the petitioner has been falsely implicated in this case and First Information Report has been lodged on account of village politics. He submits that the petitioner has been in custody since 24.07.2025 and has no criminal antecedent. 4. Learned counsel for the opposite party- State, on the other hand, has opposed the prayer and has submitted that the victim also supported the allegation in the statement under sections 180 and 183 of Bharatiya Nagarik Suraksha Sanhita, 2023. 2026:JHHC:10147 2 5. After hearing the learned counsel for the parties and considering the fact that there is direct and specific allegation against the petitioner and the victim was about 13 years of age, this Court is not inclined to enlarge the petitioner on bail and hence, this bail application is rejected. 6.
