This is an application praying for impleadment of The Union of India, represented by the Secretary, Ministry of Defence (Border Roads Division), New Delhi, as party respondent No. 17 in the connected PIL No. 07/2026 (Shri Taten Tapak -vs- The State of Arunachal Pradesh & Ors.). 3. The applicant, by way of the Public Interest Litigation, has approached this Court against payment of land compensation in respect of the “Construction/Improvement of Ditte Dimme–Migging Road from existing CL-09 Road to NHDL Specification from Design Chainage Km 0.000 to Km 51.015 (Existing Chainage Km 0.00 to Km 53.000)” under 761 BRTF Project Brahmank in Arunachal Pradesh (PKG-I & PKG-II of Part II), a project being executed by the Border Roads Organisation under the Union of India, Ministry of Defence (Border Roads Division), inter alia alleging inflated and arbitrary assessment and payment of compensation to purported landowners, inclusion of persons having no land or lawful entitlement thereto, disproportionate valuation of Page No.# 8/8 properties/assets and disbursement of compensation against non-existent or falsely projected structures. 4. Having considered that the issue raised in the connected PIL is against not only the State of Arunachal Pradesh and its authorities but also the Union of India, particularly the Ministry of Defence (Border Roads Division) and considering that this Court, vide order dated 12.05.2026, has permitted the petitioners to file an appropriate application for impleadment of the Union of India, we deem it appropriate to allow the present interlocutory application, as the Union of India, represented by the Secretary, Ministry of Defence (Border Roads Division), New Delhi, would be a necessary party for proper adjudication of the connected PIL. 5. Accordingly, the applicant is allowed to implead “the Union of India, represented by the Secretary, Ministry of Defence (Border Roads Division), New Delhi”, as party respondent No. 17 in the connected PIL No. 07/2026. 6.
