The petitioner has filed this writ petition seeking following reliefs. “10.1 That, this Hon’ble Court may kindly be pleased to direct the respondent concerned to examine case of the petitioner and grant benefits of third Time Bound Pay Scale to the petitioner in light of 2 / 3 circular issued by the State Govt. from time to time and granted similar benefit to similar employee (Patwari), within a reasonable time, as this Court deems fit. 10.2 Any other relief, which this Hon’ble Court may deem fit.” 2. Learned counsel for petitioner submits that petitioner is working as Patwari and has completed more than 30 years of service. According to the circular issued by the State Government, petitioner is entitled for time pay scale after completion of 10 years of service, 20 years of service and 30 years of service. Petitioner has been granted two time pay scale after completion of 10 years and 20 years of service, however, third time scale pay after completion of 30 years of service has not been granted and identical issue was considered and decided in case of R.S. Verma Vs. State of Chhattisgarh & Ors in WPS No.2805 of 2002 decided on 29.08.2006. He further submits that petitioner may be granted liberty to make a fresh representation for consideration of his case in light of the judgment passed by the Hon’ble Apex Court in case of State of Tripura & Ors Vs. K.K. Roy, reported in 2004 AIR SCW 1 and R.S. Verma (supra). He also submits that similarly placed employee have been extended the benefit. 3. Learned counsel for State submits that she may be granted time to seek instruction in the matter. 4. Considering the nature of grievance raised, in particular the grievance of petitioner that petitioner has completed more than 30 years of service and according to circular issued by the State Government dated 08.08.2018 and 11.06.2019, he is entitled for third time scale pay, which is not granted and further considering the decision in case of R.S. Verma (supra) and K.K. Roy (supra), this writ petition at this 3 / 3 stage is disposed of permitting petitioner to submit a comprehensive representation along with all supporting documents before respondent No.2 and in the event, petitioner submits such representation, the concerned authority shall consider and decide the same in accordance with law expeditiously preferably within a period of three months from the date of receipt of representation. 5.
