Mr. S. K. Pandey, learned counsel for the revisionist. 2. Ms. Sweta Dobhal, learned Brief Holder for the State. 3. Mr. Harshit Bisht, learned counsel holding brief of Mr. Mohit Pandey, learned counsel, for the respondent no. 2. 4. This instant revision has been preferred by the revisionist against the judgment and order dated 01.12.2022 passed by Chief Judicial Magistrate in Complaint Case No. 18 of 2020 whereby revisionist has been convicted and sentenced for the offence punishable under Section 138 of the N.I. Act, which was also affirmed by the Appellate Court in Criminal Appeal No. 94 of 2022 by judgment dated 09.04.2026. 5. The instant revision has been filed along with compounding application. 6. Learned counsel for the revisionist submits that revisionist has already paid the entire amount to the respondent – complainant and they have settled their dispute amicably. He further submits that in terms of Section 147 of N.I. Act offence punishable under Section 138 of the N.I. Act can be compounded. 7. Both revisionist and complainant joined the proceedings through V.C. and they are duly identified by their respective counsel. 8. After hearing learned counsel for the parties and taking into consideration that both the parties have settled their dispute amicably, as the entire amount has already been paid by the revisionist to the respondent complainant, which has not been denied by the learned counsel for the respondent therefore, instant revision and compounding application deserves to be allowed. 2026:UHC:3807 9. In such view of the matter instant criminal revision as well as compounding application are allowed and the judgment and order passed by the Trial Court dated 01.12.2022 in Complaint Case No. 18 of 2020 and Criminal Appeal No. 94 of 2022 are also set aside.
