Learned Addl. Government Advocate accepts notice for respondent Nos. 1 and 2. 2. The petitioner has approached this Court seeking a writ of mandamus directing respondent No.4 to release the arrears of salary payable to him for the period from the date of his removal till the date of reinstatement, i.e., from 10.04.2019 to 01.12.2022, by considering his representation dated 28.02.2024 (Annexure–H). 3. It is not in dispute that the order of removal dated 10.04.2019, was set aside by the appellate authority by order dated 03.10.2022 and reinstatement was directed. The petitioner has submitted representation seeking arrears of salary for the period from 10.04.2019 to 01.12.2022. 4. The question as to whether the petitioner is entitled for arrears of salary for the said period, and if so, to - 4 - HC-KAR NC: 2026:KHC-D:2053 WP No. 103466 of 2025 what extent, requires consideration by the competent authority in accordance with the applicable service rules and governing principles. 5. Learned counsel for the petitioner contends that, once the appellate authority set aside the order of removal and directed reinstatement, the petitioner becomes entitled to consequential benefits, including arrears of salary for the interregnum period. It is contended that the representation dated 28.02.2024 has not been considered and therefore, appropriate direction is required to be issued to respondent No.4. 6. Since the petitioner has already submitted representation seeking arrears of salary, this Court is of the considered opinion that the direction to the competent authority to consider the representation in accordance with law would meet the ends of justice. 7. A mandamus is issued, the respondent - competent authority is directed to consider the representation of the petitioner dated 28.02.2024 (Annexure-H) seeking arrears of salary for the period from the 10.04.2019 to 01.12.2022 and pass appropriate orders within a period of four weeks from the date of receipt of a certified copy of this order.
