No.12657 of 2026 ORDER The petitioner was found guilty and convicted by the II Additional District Judge (CBI Cases), Madurai District, in C.C.No.11 of 2015, by judgment dated 05.06.2025. Aggrieved by the order of conviction, the petitioner has preferred an appeal before this Court in Crl.A.(MD)No.781 of 2025. The appeal has been admitted. The petitioner has also filed an application seeking suspension of the sentence imposed by the Trial Court and, by order dated 01.08.2025 in Crl.M.P.(MD)No.9649 of 2025, this Court suspended the sentence subject to the condition that the petitioner shall report before the CBI Court, Tiruchirappalli, once in a week, i.e., on every Monday, until further orders. The petitioner complied with the said condition for a certain period and thereafter filed an application seeking relaxation of the same. This Court, by order dated 16.10.2025 in Crl.M.P.(MD)No.13233 of 2025, modified the condition directing the petitioner to appear once in a month before the Trial Court. The present application has been filed seeking relaxation of the said condition also. 2/6 https://www.mhc.tn.gov.in/judis CRL MP(MD). No.12657 of 2026 2. The learned counsel appearing for the petitioner submits that the petitioner is a resident of Puducherry and is suffering from certain ailments. It is submitted that the petitioner is immobilized and that it is very difficult for him to appear before the Trial Court every month. Therefore, the learned counsel sought indulgence of this Court to relax the condition imposed by order dated 16.10.2025. 3. The condition directing the petitioner to report once in a month before the Trial Court was imposed by this Court to ensure his availability pending disposal of the appeal. If the condition is relaxed, his whereabouts cannot be found and, he may not be available at the time of final hearing. Therefore, this Court is not inclined to entertain the petition. However, the learned counsel appearing for the petitioner produced certain medical records before this Court and attempted to substantiate the contention that the petitioner is immobilized and that it is very difficult for him to report before the Trial Court on the first working day of every English calendar month. Considering the medical records placed before this Court, this Court, in order to ascertain the physical condition of the petitioner, directed him to appear before JIPMER 3/6 https://www.mhc.tn.gov.in/judis CRL MP(MD). No.12657 of 2026 Medical College and Hospital, Puducherry, on 15.07.2026 and also directed the Dean, JIPMER Medical College and Hospital, to assess the health condition of the petitioner and submit a report. Pursuant to the said direction, the petitioner appeared and the Professors who examined him have submitted a report stating that the petitioner is suffering from a temporary physical disability of 73.8%. It is further reported that the petitioner can sit on a chair and is able to walk with the assistance of a walker for a distance of 50 to 100 meters, after which he requires rest due to pain. The relevant paragraph is extracted hereunder: "Patient is able to carry out following activities - sit on chair, able to walk with assistance walker between 50-100 meters following which he needs rest for pain, he is able to kneel down with assistance and not able to perform squatting and sitting cross-legged at present. On disability assessment he has a temporary physical disability of 73.8% which needs re-evaluation after 6 months." 4. Considering the report submitted by the Professors of JIPMER, this Court is inclined to modify the condition. However, the petitioner's 4/6 https://www.mhc.tn.gov.in/judis CRL MP(MD). No.12657 of 2026 availability during the pendency of the appeal has to be ensured. Accordingly, the petitioner is directed to appear before the Principal District Court, Cuddalore, on the first working day of every English calendar month. In the event of the petitioner's failure to appear in any month, the learned Principal District Judge, Cuddalore shall issue a Non- Bailable Warrant and communicate the same to the respondent Police regarding the conduct of the petitioner. However, the learned Principal District Judge, shall condone the petitioner's absence for any month on production of appropriate medical records, if any, in support of his case. 24.07.2026 mbi To 1.
