ABLAPL No.1556 of 2026
Sunil Behera @ Sunil Kumar Behera …. Petitioner
Mr. Jyotirmaya Sahoo, Advocate
-Versus-
State of Odisha …. Opposite Party
Mr. S.N. Das, ASC
CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 17.03.2026
01.
1. Heard learned counsel for the respective parties.
2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Rambha P.S. Case No.669 of 2024 corresponding to G.R. Case No.2080 of 2024 pending in the file of learned J.M.F.C., Khallikote on the grounds stated therein.
3. Perused the FIR as at Annexure-1. The petitioner had earlier approached this Court in ABLAPL No.12387 of 2025
disposed of by order dated 7th November, 2025 rejecting his claim for pre-arrest bail. Learned counsel for the petitioner submits that there is non-compliance of the decisions in Arnesh Kumar Vrs. State of Bihar and another (2014) 8 SCC 273 and Satender Kumar Antil Vrs. Central Bureau of Investigation and another in SLP (Crl.) No.5191 of 2021 and p. 2 even if the petitioner is having antecedent, such compliance is necessary.
4. Recorded the submission of the State.
5. Though this Court is not inclined to reconsider the pre- arrest bail in view of the order in ABLAPL dated 7th November, 2025, this Court is of the view that there is need for compliance of the decisions (supra) by the local police in connection with Rambha P.S. Case No.669 of 2024 corresponding to G.R. Case No. 2080 of 2024 pending in the file of learned J.M.F.C., Khallikote.
6. Consequently, the ABLAPL is disposed of with the direction and observation hereinabove.
7. Issue urgent certified copy as per rules.
