For Petitioner : M/s.C.R.Poongodiyal 1/4 https://www.mhc.tn.gov.in/judis ORDER The present petition has been filed by the first respondent in D.V.C.No.80 of 2026, on the file of the learned Judicial Magistrate, Additional Mahila Court, Madurai, seeking to quash the domestic violence complaint. 2. A perusal of the complaint reveals that the first respondent who is the wife of the petitioner has sought for protection order under Section 18 of the Domestic Violence Act and also for monthly maintenance and compensation. 3.According to the learned Counsel appearing for the petitioner, the petitioner is employed in Maldives and when he came back in May, he had made arrangements for a separate matrimonial home and has also paid advance. However, the first respondent is not accepting the same and hence, the present DVC complaint. He further submits that the petitioner is also ready to pay monthly maintenance also. 4. I have considered the submissions made on either side and perused the materials available on record. 2/4 https://www.mhc.tn.gov.in/judis 5. As far as the allegations as against the petitioner are concerned, specific allegations have been made and the petitioner is the only person who is answerable to the claim made by the first respondent herein and in such circumstances, the domestic violence complaint cannot be quashed 6. Considering the fact that the petitioner is employed in Maldives, his personal appearance shall be dispensed with by the Court and his appearance through video conferencing may be permitted. 7. With the above said observations, this Criminal Original Petition stands disposed of.
