Petitioner, through the medium of this petition, seeks direction upon the respondents, particularly respondent Nos. 2&3, to present and cause registration of the Lease Agreement/Deed dated 04.03.2025 regarding the Evacuee Land measuring 72 Kanals 17 Marlas, comprised under Serial No. 174 2 Khasra Nos. 628, 584, 580, 585, 586, 587, 588 & 630, situated at Village Logate, Tehsil & District Kathua, executed in favour of the petitioner company, before the concerned Sub-Registrar for registration under law, in accordance with the provisions of the Registration Act and applicable Stamp laws, in a time bound manner. 02. Learned senior counsel appearing for the petitioner submits that the parties have already executed a Lease Deed in the form of an agreement on 04.03.2025 with regard to subject land for a period of 40 years for industrial purposes and such a Lease Deed is compulsorily registrable in terms of Section 17 (1) (g) of the Registration Act, 1977 and that the petitioner has been facing difficulty in raising loan in absence of registration of Lease Deed. 03. Learned senior counsel appearing for the petitioner further submits that the petitioner shall be satisfied in case, this petition is disposed of at this stage with direction to the parties to the Lease Deed to appear and submit the execution before the Registration Authority for registration of the Lease Deed, within time bound frame. 04. In view of the facts and circumstances of the case and submissions made by learned counsel for the petitioner, this petition is disposed of at this motion stage with direction to the respondents particularly, who is signatory to the Lease Deed, to appear before the Registration Authority and submit the Lease Deed for Registration within a period of 15 days from the date a certified copy of this order is served upon him/her. In the 3 event, the petitioner presents the Lease Deed, the Registration Authority shall consider the same in accordance with law, expeditiously. 05.
