ORDER The present petition has been filed by the sole accused in CC No. 1076 of 2017 on the file of Judicial Magistrate No.IV, Thoothukudi, seeking to set aside the order passed by the trial Court in Crl.M.P.No.13 of 2026, wherein, the petition filed by the petitioner under Section 311 of Cr.P.C., has been rejected. 2.Perusal of the impugned order reveals that the petitioner is charged with the offence under Sections 419, 465, 468, 471 and 420 of IPC. PW1 to PW9 have been chief examined in the year 2021 and they were not cross examined on the same day of their appearance. The present application has been filed on 03.03.2026 seeking to recall PW1 to PW9 on the ground that the petitioner was affected with Jaundice in the year 2021, therefore, he could not cross examine the listed witnesses. It is further contended that he has changed the counsel and therefore, the present application has been filed seeking to recall PW1 to PW9, has been dismissed by the trial Court on the ground of delay. Challenging the same, the present petition has been filed. 2/5 https://www.mhc.tn.gov.in/judis
