The instant application has been filed under Section 5 of the Limitation Act, 1963 praying for condonation of delay of 93 days in filing the connected revision petition against the Judgment & Order dated 22.09.2025 passed by the FTSC (CPI) in POCSO Case No. 82/2025 corresponding to KZL P.S. Case No. 55/2024 under Section 4/8 of the POCSO Act by which the revisionist was convicted and sentenced to undergo RI for three (3) years with a fine of Rs. 1000/- and to undergo SI for one (1) month. Notices were issued to the respondent Nos. 2 and 3 and tracking report
Page No.# 3/3 shows that the notice has been delivered to both the respondents. On 07.05.2026 none appeared for the respondent Nos. 2 and 3. Today when the matter is called also, there is no representation for the respondent Nos. 2 and 3. The learned Addl. Public Prosecutor, Mrs. Vanneihsiami appears for the State respondent and submits that she has no objection regarding the delay.
Heard Mr. Lalpianfela Chawngthu, learned counsel for the applicant/petitioner. The reasons for the delay has been set out at paragraph No. 2 of the application. The Court has gone through the same and is satisfied that sufficient cause has been shown for the delay of 93 days in filing the connected criminal revision petition. Accordingly, the delay of 93 days is condoned and the application is allowed. JUDGE Comparing Assistant
