(2) Petitioner is aggrieved by recovery citation, issued by Tehsildar, Garur for recovery of ₹9,76,950. It is contended by learned Counsel for the petitioner that due to financial hardship faced by petitioner, he could not repay the loan in time. He submits that petitioner is ready and willing to liquidate the loan as early as possible and he may be perm itted to deposit the outstanding am ount in instalments. (3) Learned Counsel appearing for the bank submits that bank has no objection if petitioner is given some reasonable time for repaying the loan. (4) In view of consensus between the parties, writ petition is disposed of with the following directions: “(i) Petitioner shall deposit 20 per cent of the outstanding amount with the Branch Manager of the concerned bank within two weeks. (ii) Subject to deposit of the aforesaid amount within stipulated time, petitioner shall be perm itted to repay the remaining amount in nine equal monthly instalments. (iii) Last instalment shall carry the component of interest. 2026:UHC:3938 (5) In case of any default on the part of petitioner in abiding the aforesaid conditions, bank shall be at liberty to proceed against him, as per law.
