ORDER This Writ Petition is taken up for final hearing at the time of admission with the consent of the learned counsel for the petitioner and the learned Government Standing Counsel for the respondents 1 to 3, after dispensing with the notice on the private respondents, as no adverse order are proposed to be passed against them.
2. The petitioner claims to be a Hereditary Trustee of Thanwer Panthal Dharmam in respect of which a scheme decree was passed by the Sub Court, Thanjavur in O.S.No.332 of 1974 vide its judgment and decree dated 15.10.1977. 2/6 https://www.mhc.tn.gov.in/judis
W.P.(MD) No. 20470 of 2026 Already, an order has been passed by the Deputy Tahsildar in his proceedings dated 29.02.2008, bearing reference in Tho.Mu.Pa.Maa(2) 4355/2008 Aa8, wherein it has been clarified as follows:

3. It is, however, submitted that the name of one Aruputhasamy is wrongly included in the patta of the temple represented by the petitioner. In this regard, the petitioner had earlier filed a Writ Petition in W.P.(MD) No.3531 of 2026 to remove the name of the said Arputhasamy by considering the petitioner’s representation dated 24.12.2025, wherein the said Arputhasamy was impleaded as 5th respondent. This Court, by its order dated 09.02.2026, has ordered as under:
“5. Recording the above submissions and without expressing any opinion on the merits of the matter, this Writ Petition is
disposed of with a direction to the third respondent to consider the petitioner’s representation dated 24.12.2025 and pass orders on 3/6 https://www.mhc.tn.gov.in/judis
W.P.(MD) No. 20470 of 2026 merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be disposed of after conducting an enquiry. The third respondent shall afford a reasonable opportunity of hearing to the petitioner, the fifth respondent and all other interested parties before passing orders. In the event of any rival claims, the parties are at liberty to work out their remedies before the competent Civil Court. No costs.”

It is the case of the petitioner that pursuant to the above order, the respondents have not conducted any enquiry and now, the private respondents 4 to 6 have attempted to take over the temple property and interfere with the day-to- day affairs of the temple. Hence, the petitioner has approached this Court.
5. It is noticed that the relief sought for in the writ petition cannot be granted, as respondents 1 to 3 have no jurisdiction to call for the Peace Committee Meeting.
6. In case there is any law and order situation, appropriate steps can be taken to break down the law and order situation under Section 152 of Bharatiya Nagarik Suraksha Sanhita, 2023. In case the petitioner apprehends any such event, the petitioner can approach the jurisdictional Executive Magistrate/second 4/6 https://www.mhc.tn.gov.in/judis
W.P.(MD) No. 20470 of 2026 respondent for appropriate relief. Otherwise, the petitioner has to work out his remedy before the Civil Court to restrain the private respondents.
