A communication has been received under the signature of the In- charge, Additional Judicial Commissioner-III-cum-P.O. Commercial Court, Ranchi addressed to the Assistant Registrar of this Court reporting about the fact of death of the sole appellant namely, Sanjay Ram @ Charka alongwith the death certificate dated 05.05.2014. 3. This Court has perused the communication dated 25.03.2026 as also the death certificate and found that the appellant has died on 18.04.2014. 4. No application has been filed on behalf of the legal representative which is said to require to be filed under Section 394 of Cr.PC pari materia 535 to the B.N.S.S. for proceeding further with the appeal. 2 5. This Court, considering the fact about the death of the sole appellant as also no application being filed on behalf of the legal representative even after lapse of 12 years, is of the view that the appeal is to be abated. 6.
