The Court made the following: 5 THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO: 18736/2026 ORDER:- This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:- “to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in laying the proposed 765 KV D.C. Transmission Line (High Tension lines) from Anantapur-ll REZ to Kadapa Power Grid Substation through the lands, residential habitations, commercial establishments and temple lands situated in and around Gorlapalli, Kommavaripalle and surrounding villages of Chinthakommadinne Mandal, YSR Kadapa District, without considering the objections and representations submitted by the petitioners and other affected villagers, as illegal, arbitrary and violative of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondents to consider the objections and representations submitted by the petitioners and other affected villagers and reconsider the alignment of the proposed 765 KV D.C. Heard learned counsel for the petitioners, learned Assistant Government Pleader for respondent No.1, the learned Standing Counsel for the respondent Nos.2 to 4, learned Assistant Government Pleader for respondent Nos.5 and 6 and the learned Standing Counsel for respondent Nos.7 to 9. 3. Learned counsel for the petitioners submits that the petitioners are residents of Apparajupalle Village, Chinthakommadinne Mandal, YSR Kadapa District and thus have been doing agricultural operations against their 6 respective land owned by them. While so, the respondent authorities i.e,. respondent Nos.7 to 9 issued a public notice on 10.04.2025 informing about the laying of high tension electrical lines i.e., 765 KV DC transmission line which is passing through so many villages including the village of the petitioners and also through the petitioners’ properties and called for objections. Pursuant to the said notice, the petitioners herein have submitted their objections through registered posts with acknowledgments as per the address provided in the public notice. But to the surprise of the petitioners, the said registered posts were returned with an endorsement ‘addressee left’. He further submits that now the respondents are taking steps without considering the representations/objections of the petitioners, even though the respondents issued a public notice calling for objections from the affected parties. He further submits that the Central Electricity Authority (Measures relating to Safety and Electric Supply) Regulations, 2023 (hereafter referred as ‘Regulations, 2023’) enunciated some safety measures to be mandatorily observed by the authorities concerned. But by dehorsing and without considering the objections of the petitioners, the respondents are proceeding with the laying of the high tension electrical lines is contrary to law. Hence, the Writ Petition. 4. On the other hand, learned Standing Counsel for respondent Nos.2 to 4 and respondent Nos.7 to 9 submits that the as per the contention of the learned counsel for the petitioners regarding observation of the Regulations, 2023 are mandatory, the respondents would observe the same scrupulously 7 without there being any deviation. He further submits that let there be a direction to the respondent authorities to observe Regulations, 2023 and safety measure as indicated therein. It is further submitted that laying of entire proposed lines i.e., 765 KV DC transmission line was entrusted to respondent Nos.7 to 9, the authorities would take all the safety measures as contemplated under Regulations, 2023. 5. Considering the submissions made by all the learned counsel and on perusal of the material placed on record, it is observed that as per Regulation, 2023, the respondent authority shall observe the factors while laying high tension transmission lines. Learned Standing Counsel for the respondents contended that the respondents would observe all the safety measures as canvassed by the petitioners while laying the proposed high tension transmission lines. He further submits that except the house or any establishment came up after issuance of notice, regarding all other premises which are already in existence before notice, the safety measure would be observed by respondent Nos.7 to 9. 6. In view of the facts as stated above, the Writ Petition is disposed of directing the respondent Nos.1 to 9 shall observe all the safety measure as per the Regulations, 2023, without there being any deviation and also directed respondent No.5 to consider the representations of the petitioners if any pending with him, within a period of four(4) weeks from the date of receipt of copy of this Order. If the petitioners intended to submit a fresh representations, they shall submit the same, within a period of two(2) weeks 8 from the date of receipt of copy of this Order. After such submission, respondent No.5 shall consider the same and pass appropriate orders, within a period of four(4) weeks thereafter. There shall be no order as to costs.
