The State is on appeal questioning the order of the learned Single Judge, dated 15.07.2025 in the writ petition filed by the respondent herein. 2.The writ petition had been filed seeking a mandamus to disburse the salary and other allowances for Mr.A.Johnson Antonyraj, who had been appointed as sweeper on and from 31.01.2017 till 08.03.2019 together with all consequential benefits. 3.It had been contended in the writ petition that appointment of Mr.A.Johnson Antonyraj as sweeper had been approved by the appellant herein. Once approval had been granted for such appointment, then naturally for the work discharged and the service rendered, salary will have to be paid. The writ petition has been filed complaining that there had been no disbursement of salary for the period of work discharged by Mr.A.Johnson Antonyraj. 4.We have examined the order of the learned Single Judge. The learned Single Judge had applied the observations in earlier writ petition, wherein it was held that when the approval is granted, then disbursal of salary should be from the date of appointment and the denial of the same would be violation of Article 21 of the Constitution of India. WA(MD) No. 1018 of 2026 __________ Page3 of 4 by the Joint Director of Collegiate Education. Tiruchirappalli Region by proceedings in Na.Ka.No.7142/E2/2018-14 dated 13.10.2022 and such approval was from the date of initial appointment.
It is also to be noted that the proposal seeking disbursement of arrears of salary was returned by the Joint Director only due to the allocation of funds to the Department for the financial year 2023-24. As a concept, the salary has to be disbursed once approval has been granted from the date of appointment. 5.We find no reason to interfere with the order of the learned Single Judge. The appellants should disburse the entitlements within a period of three (3) months in accordance with the entitlement permissible for Mr.A.Johnson Antonyraj, who had been working as Sweeper from 31.07.2017 to 08.03.2019 on or before 30.09.2026. 6.This writ petition stands dismissed.
