PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL) 19.03.2026 01. 1. This is a bail application U/S.483 of BNSS by the petitioners for grant of bail in connection with Baranga P.S. Case No.39 of 2026 corresponding to G.R. Case No.96 of 2026 pending in the file of learned JMFC- II (Cog. Taking), Cuttack, being charge sheeted for commission of offences punishable U/Ss. 296/126(2)/ 351(3)/ 308(4)/109(1)/61(2)/111(2)(b)/111(3)/3(5) of BNS and section 25(1)(b)/27 of Arms Act. 2. The allegation against the petitioner stems from the facts that one Trilochan Pradhan has been possessing a piece of land in Kunheipada Mouza Trisulia, Baranga by purchasing it and he thereafter made an agreement with Chabindra Muduli and Dibakara Muduli to develop the said land, however, one Litua Behera of Bidanasi claiming him to be a henchmen of gangster Dhalasamanta threatened him to handover the land to one Ashis Kumar Mohanty, otherwise to face the consequence, however, on 15.01.2026, when the complainant and his friends were on the land near Trisulia, the said Litua Behera, Sura Singh and Santosh Sasmal and others suddenly came there and threatened them to kill by abusing and they forcefully trespassed into the land with a JCB and destroyed the peripheral boundary walls and asked Trilochan Pradhan to leave the said land soon, otherwise he would be killed. Accordingly, Trilochan Pradhan has lodged an FIR, which was registered as Baranga P.S. Case No. 39 of 2026 and the petitioners were taken into custody ultimately landing them before this Court in this bail application. 3. Heard, Mr. Sushanta Kumar Samantaray, learned counsel for the petitioners and Mr. S.C. Pradhan, learned Addl. PP in the matter and perused the record. 4. Admittedly, the name of petitioner Ayush Mohanty, Papun Behera and Sidhant Om Prakash do not figure out in the FIR, but the petitioners are in custody since 18.01.2026. Besides, co-accused Ashis Mohanty @ Ashis Kumar Mohanty and Soubhagya Muduli @ Bunti Muduli, whose names find place in the FIR already have been given the benefit of bail in ABLAPL Nos 1001 & 1068 of 2026. In the aforesaid facts and situation and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-a-vis the accusations sought to be brought against them and there being substantial progress in investigation and last but not the least, taking into account the pre-trial detention of the petitioners in custody together with their inherent right to be presumed innocent until proven guilty at the trial and there being no injury inflicted to any body by the petitioners, this Court without expressing any view on merits, admits each of the petitioners to bail. 5. Hence, the bail application of the petitioners stands allowed and each of the petitioners is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) each with one solvent surety for the like amount to the case on such terms and conditions as deems fit and proper by it in addition to the condition that the petitioners shall not enter into the aforesaid land of the informant, unless he is not entitled to possess thereof. 6. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e- mail for reference. (G.
