For Petitioner: Mr.A.Kanaka Velappan For Respondents: Mr.R.Ganesh Kumar Counsel for Government of Tamil Nadu (Crl.Side) For R1 to R5 Mr.A.Srinivasan For R6 ORDER This Writ Petition (Criminal) has been filed seeking a direction to the fourth and fifth respondents to grant permission and provide adequate police protection for conducting the temple festivals at Sri Devi Elankaliyamman Kovil, situated at T.J.Road, Thirumazhisai, Chennai, on 17.07.2026, 25.07.2026 and 16.08.2026, based on the petitioner’s representation dated 07.07.2026. 2. Heard the learned counsel appearing on either side and perused the materials available on record. 3. The petitioner claims to be the President of Sri Devi Elankaliyamman, Sri Devi Ellai Amman, Sri Selva Vinayakar Temple, and https://www.mhc.tn.gov.in/judis WP Crl. No. 1752 of 2026 __________ Page3 of 8 states that he has been administering the affairs of the temple from the year 2023 onwards. It is the case of the petitioner that the temple festivals, namely Panneer Kudam Abisegam on 17.07.2026, Pallkudam Abisegam on 25.07.2026 and Thee Mithi Thiruvizha on 16.08.2026 are scheduled to be conducted. In this regard, the petitioner submitted a representation seeking permission and adequate police protection to conduct the aforesaid festival on the respective dates. 4. The learned counsel appearing for the petitioner submitted that the sixth respondent has produced fabricated documents in support of his claim. It was further submitted that no Extraordinary General Body Meeting was convened for the purpose of electing new office bearers to the Sangam, and therefore, the claim of the sixth respondent that he was elected as the President is wholly untenable. 5. Per contra, the learned counsel appearing for the sixth respondent submitted that the petitioner is no longer acting as the President and he was removed from the said post long ago. It was further submitted that the sixth respondent was duly elected as the President of Prayampattu Sri Devi Ilankaliyamman, Sri Devi Ellaiyamman, Sri Selva Vinayagar Alayangalain Vanniyagula Sathriyargal Anmiga Sangam. In fact, the sixth respondent has also filed a suit in O.S.No.238 of 2026 on the file of the Additional District https://www.mhc.tn.gov.in/judis WP Crl. No. 1752 of 2026 __________ Page4 of 8 Munsif Court, Poonamallee, against the petitioner and others, seeking the following prayers : “a) granting a mandatory injunction directing 1st defendant to hand over all records, registers, keys, seals, digital credentials, bank records and movable assets of the Society to the plaintiff. b) permanent injunction restraining the 1st defendant, his men, agents or anybody claiming under or through him in any way interfering with the plaintiff society’s administration, maintenance, interfering with rituals and control of the temples described in the schedule. c) permanent injunction restraining the 1st defendant from representing himself as president or office bearer ; collecting subscriptions/donations in the name of the Society or the temples ; using the Society’s name, seal, documents, digital credentials or online portal maintenance. d) mandatory injunction directing the 1st defendant to render true and proper accounts of all collections made after removal of him from the post of President of the Plaintiff. e) permanent injunction restraining 2nd defendant from entertaining or acting upon any communication, filing, return, representation or document submitted by 1st defendant purporting to represent the plaintiff Society after 13.06.2026. f) mandatory injunction directing the 2nd defendant to receive, record, recognize and give effect to the resolutions passed in the Extraordinary General Body meeting dated 13.06.2026 and to accept all statutory filings made through the present President and Executive Committee. g) for the costs of the suit.” https://www.mhc.tn.gov.in/judis WP Crl. A perusal of the plaint filed by the sixth respondent on behalf of the Prayampattu Sri Devi Ilankaliyamman, Sri Devi Ellaiyamman, Sri Selva Vinayagar Alayangalain Vanniyagula Sathriyargal Anmiga Sangam reveals that the plaintiff Society claims to be the owner and administrator of Sri Devi Elankaliyamman, Sri Devi Ellai Amman, Sri Selva Vinayakar Temples. It is stated that the petitioner was elected as the President of the Society in the General Body meeting held on 22.10.2022. According to the plaint, during his tenure, instead of administering the affairs of the Society in accordance with provisions of the Tamil Nadu Societies Registration Act and the Bye-laws of the plaintiff society, the petitioner acted arbitrarily and in complete disregard of the collective decisions of the executive committee and the General Body. He also involved in anti social activities. The plaint further states that, in view of the above, one-third of the members of the Society invoked Clause 19 of the Bye- laws and submitted a written requisition to the Executive Committee on 17.04.2026 to convene an Extraordinary General Body Meeting. Pursuant thereto, an Extraordinary General Body Meeting was convened, in which the sixth respondent was elected as the President of the Society. Thereafter, the sixth respondent assumed charge and has been administering the affairs of the Society and the temples. 7. It is further stated in the plaint that, upon assuming office, the newly elected Executive Committee directed the petitioner to hand over the https://www.mhc.tn.gov.in/judis WP Crl. No. 1752 of 2026 __________ Page6 of 8 entire records of the Society, including the minute books, account books, registers, statutory records, bank records, seals and all movable properties belonging to the Society and the temples. However, the petitioner failed and refused to hand over the same and as such, the sixth respondent was constrained to file a suit in O.S.No.238 of 2026 on the file of the Additional District Munsif Court, Poonamallee, seeking appropriate relief and it is pending for adjudication. 8. In view of the above, the request made by the petitioner for grant of permission and police protection to conduct the temple festivals at Sri Devi Elankaliyamman Kovil, situated at T.J.Road, Thirumazhisai, Chennai, cannot be considered. Thus, the writ petition lacks merit and is liable to be dismissed. Accordingly, this Writ Petition (Criminal) stands dismissed. However, the petitioner is at liberty to approach the Civil Court for appropriate relief.
