For Petitioner(s): Mr.R.Singaravelan, Senior Counsel for Mr.S.N.Ravichandran For Respondent(s): Ms.P.T.Ramadevi, Standing Counsel for R1 Mr.A.R.Balaji, Government Advocate for R2 https://www.mhc.tn.gov.in/judis WP No. 29184 of 2026 __________ Page2 of 5 ORDER This writ petition is filed for the following relief: “calling for the records relating to the impugned order of Suspension issued by the 1st respondent in his proceedings in GDC.No.E13/20668/2026 dated 17.07.2026 and quash the same and consequently to direct the 1st respondent to settle the terminal benefits of GPF, Special PF, Encashment of Earned Leave and Private Affairs due to the petitioner, within a reasonable period as may be fixed by this Court.” 2. The petitioner is working as Assistant Executive Engineer, in Zone 6 of the Greater Chennai Corporation at Strahans Road, Thiru.Vi.Ka.Nagar, Pattalam, Chennai – 600 012. The petitioner is due to retire on 31.07.2026 on attaining the age of superannuation. However, to his shock and surprise, the first respondent vide proceedings dated 17.07.2026 has placed the petitioner under suspension based on the FIR filed by the second respondent in FIR.No.06/AC/2026/AA-II dated 06.07.2026, under Sections 7 and 8 of the Prevention of Corruption (Amendment) Act, 2018 which is per se unsustainable. Challenging the same, the present writ petition has been filed. 3. Heard the learned counsel on either side and perused the materials available on record. 4. The learned counsel for the petitioner would submit that though the https://www.mhc.tn.gov.in/judis WP No. 29184 of 2026 __________ Page3 of 5 writ petition has been filed for the aforementioned relief, it would suffice that this Court may direct the respondents to permit the petitioner to retire on 31.07.2026, in the light of the amendment to Rule 56 of the Tamil Nadu Fundamental Rules. 5. The learned counsel for the respondents are also agreeable to the same, however, without prejudice to their right to continue the pending disciplinary proceedings. 6. In the light of the above submissions made by the learned counsel on either side, the petitioner is permitted to retire on the forenoon of 31.07.2026, in terms of the amendment to Rule 56 of the Tamil Nadu Fundamental Rules, in and by which sub rule (1), clause (c) including the explanation, instruction and the ruling have been omitted, subject to the provisions of the amended Rule 56(1-A) of the said Rules. 7. With the above observation, this writ petition is disposed of. No costs.
