The limited prayer made by the petitioner in the present writ petition is 2 that against the impugned judgment and decree dated 17.12.2024, the petitioners have filed the first appeal No. 10A/2025 before the learned Third Additional District Judge, Surajpur on 25.02.2025, however, the said appeal has not been decided till date and, therefore, the learned First Appellate Court may be directed to decide the appeal filed by the petitioners within a stipulated time frame, in accordance with law. 2. I have heard learned counsel for the petitioners and perused the order sheets of the learned trial Court. 3. From perusal of the order sheets, it transpires that on 25.02.2025 the petitioners have filed the first appeal before the learned First Appellate Court in which the respondents have made their appearance on 03.04.2025 and the first appeal was ripe up for final hearing, yet it has been adjourned for one or other reasons on various dates and it was lastly fixed on 16.03.2026. 4. Considering the fact that the first appeal before the learned First Appellate Court was ripe up for final hearing, and it is pending since 25.02.2025, the learned First Appellate Court is directed to decide the first appeal filed by the petitioners bearing first appeal No. 10A/2025 as early as possible preferably within four months from the next date fixed before it, in accordance with law and after giving opportunity of hearing to the parties concerned. 5.
