By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seek quashing of FIR No.38/2006 dated 15.01.2006 registered at PS.: Mehrauli, Delhi under Sections 279/337 of the Indian Penal Code, 1860 (IPC) and Sections 3/181 of the Motor Vehicles Act, 1988 all proceedings emanating therefrom, in view of the Affidavit dated 06.03.2026 of LR of respondent no.2 [Annexure P8], whereby she has compromised the aforementioned case with the petitioner vide order dated 28.05.2024 passed by this Court in CRL. Revision Petition No.28/2019, as also the present petition is This is a digitally signed order. Learned APP for the State accepts notice, and submits that he has no objection to the quashing of the aforesaid FIR. 3. The LR of respondent no.2, appearing through video conferencing, also accepts notice and affirms the Affidavit dated 06.03.2026, whereby she has already received a sum of Rs.7,00,000/- as full and final settlement of all her present, past and future claims vide order dated 28.05.2024 passed by this Court in CRL. Revision Petition No.28/2019. Thus, she submits that she has no objection to the quashing of the aforesaid FIR. 4. In fact, the petitioner showing his bona fide, has also furnished an additional amount of Rs.50,000/- vide Demand Draft dated 16.03.2026, bearing no.048033002846 (Canara Bank, Branch-Sector 51, Noida, Gautam Buddha Nagar) in Court to the learned counsel appearing for LR of respondent no.2. 5. The petitioner and the LR of respondent no.2, present in Court, as well as their credentials, as on record, have been identified by the Investigating Officer. 6. Since, the matter has already been settled between the petitioner and the LR of respondent no.2 and an Affidavit has already been filed by the LR of respondent no.2 to that effect, they shall remain bound by all the terms and conditions thereof. As such, following the law laid down by the Hon’ble Supreme Court in Jitendra Raghuvanshi & Ors. vs. Babita Raguvanshi & Anr. (2013) 4 SCC 58, Gian Singh vs. State of Punjab & Anr. (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. (2014) 6 SCC 466, since there is nothing left to corroborate and prove the case of the prosecution, continuation of the aforesaid FIR This is a digitally signed order.
