Chauhan, learned DAG with Mr. Vikash Uniyal, learned Brief Holder, for the State of Uttarakhand. 3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant - Jagat Singh, who has been accused in FIR No.04 of 2026, under Sections 8/20/29/60 of the NDPS Act, and under Sections 111 (2) (ii), (3) (4) of the BNS, at Police Station Lansdowne, District Pauri Garhwal. 4. As per the prosecution story that on 12.03.2026, the Police Team was conducting a checking near “Deryakhal Tiraha – Rikhnikhal Road”, during checking, two suspicious vehicles coming from the Chundai side attempted to stop and turn back after seeing the Police. The Police intercepted both vehicles and apprehended the drivers, while they were allegedly trying to flee. The drivers disclosed their names as Love Kumar and Yashwant Singh. Upon search of the vehicles, several plastic sacks containing alleged ganja were recovered. The police weighed the recovered contraband and alleged recovery of commercial quantity of ganja. During interrogation, co-accused persons disclosed that they were transporting the contraband on the instructions of Jagat Singh (present Applicant) and another co-accused. 5. Learned counsel for the Applicant submits that the Applicant has been falsely implicated in the present case and has been made scapegoat. He further submits that the Applicant is not named in the present FIR, and there is no recovery from his possession. The Applicant is languishing in jail since 26.03.2026. 6. It is also contended by the learned counsel for the Applicant that the co-accused, namely, Ramswaroop Nautiyal, Rajendra Singh and Bittu Saini, have already been granted bail by this Court, and the Applicant is entitled to bail on the ground of parity. 7. The bail application of the Applicant has been vehemently opposed by the learned State Counsel. 8. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail. 9. Accordingly, bail application is allowed. It is directed that the Applicant - Jagat Singh, who has been accused in FIR No.04 of 2026, under Sections 8/20/29/60 of the NDPS Act, and under Sections 111 (2) (ii), (3) (4) of the BNS, at Police Station Lansdowne, District Pauri Garhwal, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court.
