Section 120B of IPC, in Crime No.116 of 2026 on the file of the respondent police, seeks anticipatory bail. 2. The allegation against the petitioner is that the accused Nos.1 and 2 along with the other accused including the petitioner misrepresented themselves as real estate developers and induced several individuals to share their KYC documents to secure high value personal loans under the guise that EMI would be paid by the firm and the funds invested profitably. After disbursement of the loan totaling to Rs.7.40 Crores, they have committed default. Hence, the case. 3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and that he has not committed any offence as alleged by 2/6 https://www.mhc.tn.gov.in/judis Crl.O.P.No.16032 of 2026 the prosecution. He further submitted that the petitioner is ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner. 4. The learned counsel appearing for the intervenor submitted that the petitioner and the other accused persons have projected themselves as real estate developers/Promoters and received huge amount from various persons and cheated them. 5. The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and, submitted that the total amount defrauded is Rs.7.40 Crores and the petitioner himself has cheated almost Rs.98,00,000/- and the investigation is still pending. Hence, he opposed the grant of anticipatory bail to the petitioner. 6. Considering the submission made by the learned Government Advocate (Crl. Side) appearing for the respondent police and the fact that a huge amount of Rs.7.40 Crores was cheated by the accused persons and that the investigation is still pending, unless the petitioner is taken into custody, it 3/6 https://www.mhc.tn.gov.in/judis Crl.O.P.No.16032 of 2026 is too difficult for the victims to unearth the amount cheated by him. In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. 7.
