02/10.04.2026 Heard learned counsel for the petitioner and learned A.P.P for the State.
2. The petitioner is apprehending his arrest in connection with Taratand P.S. Case No. 21 of 2024, registered for the offence under Sections 304B/34 of the Indian Penal Code, pending in the Court of learned Chief Judicial Magistrate, Giridih.

Learned counsel appearing for the petitioner submits that the petitioner happens to be the maternal uncle-in-law of the deceased. He submits that the father-in-law and mother-in-law of the deceased have faced trial and they have been acquitted. He next submits that the petitioner is not residing in the same village and the entire family members have been made accused.
4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the witnesses have taken the name of this petitioner.
5. Considering that father-in-law and mother-in-law have faced the trial and they have been acquitted and even the informant has turned hostile in the said case and the petitioner happens to be maternal uncle- in-law of the deceased and residing in other village, and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
