(2) Petitioner’s husband was serving as Fitter in Bazpur Cooperative Sugar Factory Ltd., who died while in service on 29.7.2025. According to petitioner, the amount of gratuity of her late husband has not been released so far. The relief sought in the writ petition is as follows: “i) Issue a writ order or direction in the nature of Mandamus directing the Respondents to forthwith release the gratuity amount of ₹10,44,946/- to the Petitioner along with interest @ 18% per annum.” (3) On the last date, Mr. T.A. Khan, learned Senior Counsel appearing for sugar factory, subm itted that petitioner has not submitted ‘No Dues Certificate’, therefore amount of gratuity could not be released in her favour. (4) Learned Counsel for the petitioner submits that petitioner has submitted ‘No Dues Certificate’ on 19.5.2026. Mr. T.A. Khan does not dispute the said submission, made on behalf of petitioner. (5) Writ petition is, accordingly, disposed of by directing the General Manager of the concerned sugar factory to release 50 per cent of the amount payable 2026:UHC:3934 as gratuity within two months from today and remaining amount shall be released in favour of petitioner within three months thereafter. (6) In case entire amount of gratuity is not released within five months, then petitioner shall be entitled to interest @ 9 per cent per annum for the delayed payment of the outstanding am ount.
