Petitioner has filed this writ petition seeking following reliefs:- “10.1Issue an appropriate writ, order or direction, particularly in the nature of Mandamus, commanding the Respondent Authorities to absorb the petitioner in the ALFIZA BAIG Digitally signed by ALFIZA BAIG Date: 2026.01.15 13:58:38 +0530 2 / 4 regular cadre of Chief Municipal Officer (B-Grade) with effect from the date on which similarly situated employees, including Shri G.S. Kshtri, were absorbed, along with all consequential service benefits before January 31, 2026. 10.2 Issue an appropriate wit, order or direction particularly in the nature of Mandamus, commanding the respondent authorities to decide the claim of petitioner regarding absorption in the petitioner in the regular cadre of Chief Municipal Officer (B-Grade), with effect from the date on which similarly situated employees, including Shri G.S. Kshtri, were absorbed, along with all consequential service benefits before January 31, 2026. 10.3 Direct the respondents to grant the petitioner all consequential benefits, including fixation of pay, seniority, continuity of service, arrears of salary, pensionary benefits and all other admissible benefits flowing from such absorption. 10.4 Quash and set aside any implied or express decision, communication or stand of the respondent authorities whereby the petitioner’s claim for absorption has been denied, delayed or kept pending without lawful justification. 10.5 Award costs of the present writ petition in favour of the petitioner. 3 / 4 10.6 Pass such other and further order(s) as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice and equity.’ 2. Learned counsel for the petitioner submits that petitioner was appointed as Depot Manager in Madhya Pradesh Road Transport Corporation, Bhopal. After reorganization of State of M.P. petitioner was allocated in State of Chhattisgarh, however Road Transport Corporation was not continued and it was abolished. Employees appointed by Road Transport Corporation were deputed in different departments and according to knowledge of petitioner almost all the employees were absorbed in different departments of State Government or in the Municipal Corporation/ Municipal Council where they are posted. When the petitioner services were not absorbed, petitioner made several request and recently the respondent no. 2 had initiated proceedings for absorbing the petitioner’s service on the vacant post of Chief Municipal Officer Grade-B but till date proceedings have not been concluded. According to the date of birth of petitioner, petitioner is going to attain the age of superannuation on 31.01.2026, therefore, direction be issued to respondent no. 2 to complete the proceedings pending prior to 31.01.2026. 3. Learned counsel for State submits that in view of limited prayer made by learned counsel for petitioner, she is having no objection. 4. Heard learned counsel for the respective paries and also perused the documents enclosed along with this writ petition. 4 / 4 5. Perusal of document Annexure P-10 dated 13.10.2025 would show that respondent no. 2 wrote letter to respondent no. 1 mentioning the proceedings with regard to absorption of petitioner in which it is also mentioned that the consent of the Public Service Commission has also been obtained for absorption of service of petitioner on the vacant post of Chief Municipal Officer (Grade B) (filled by direct appointment). In this regard, however the proceedings is pending for approval of the council ministers. 6. In the aforementioned facts of the case, this writ petition is disposed of at this stage directing respondent no. 2 to make earnest efforts to conclude the proceedings of absorption of service of petitioner as mentioned in the proceedings of letter dated 13.10.2025, expeditiously, preferably within a further period of 2 weeks from the date of receipt of order. 7.
