ORDER The prayer in the Criminal Original Petition is to quash the First Information Report in Crime No.11 of 2026, which is registered for the offence under Sections 78 of BNS and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act.
2. Upon perusal of the allegations contained in the complaint, the de facto complainant states that, when she is working along with the accused, who is the Security Officer, he made advances to her with sexual overtures and harassed her by making messages and also phone calls, insisting that she should develop a relationship with him. Therefore, prima facie, when the offence are made out, the case was registered.
3. The contentions that are raised now in the Criminal Original Petition are factual in nature. The same cannot be taken as incontrovertible at this stage of quashing the FIR and this Court cannot interfere. Therefore, keeping open the liberty of the petitioner to furnish such information to the Investigating Officer, if he chooses to and to raise all these grounds at the appropriate stage, the Criminal Original Petition at this stage cannot be entertained and as such, is
