For Petitioner(s): Mr.D.Padmanabhan For Respondent(s): Mr.M.Mohamed Riyaz Government Advocate (Criminal Side) For R1 ORDER The prayer in the criminal original petition is to quash the final report in PRC No.96 of 2026 on the file of the learned Judicial Magistrate No.II, Coimbatore, in crime No.52 of 2024. https://www.mhc.tn.gov.in/judis CRL OP No. 19618 of 2026 __________ Page2 of 5 2.It is now brought to the notice of this Court that now, the case in PRC No.96 of 2026 has been committed and is taken on file as SC.No.259 of 2026 on the file of the V Additional District Court, Coimbatore. 3.Upon perusal of the First information Report, the materials collected during the investigation and the final report, the gist of allegation is that the defacto complainant being the receptionist of the particular private hotel lodged the complaint to the effect that originally, room No.210 was booked by this petitioner Logeshwari for one day. However on the next day, without vacating the room, she informed that from the next day onwards, her friend, namely, Reega Jenifer will come and occupy the room. Thereafter, Reega Jenifer and subsequent persons kept on occupying the room without vacating and ultimately one day during the cleaning, it was found that the persons staying in the room are possessing arms, such as, Aruval. Thereafter, the case was registered and after investigation, it is found that the accused persons have taken the room so as to hatch a conspiracy and commit further offences in and around Coimbatore area and hence, the case. 4.The contention of the learned counsel for the petitioner that the petitioner merely stayed in the room and vacated the room and she did not say about the continuation in the next day. https://www.mhc.tn.gov.in/judis CRL OP No. 19618 of 2026 __________ Page3 of 5 5.Per contra, the learned Government Advocate (Criminal side) would submit that even though it is true that there are materials against all the other accused with reference to involvement of the offences, in possession of the deadly arms, such as Aruval etc., this petitioner only help them by booking the room on the first day by giving her Aadhaar card. 6.I have considered the rival submissions made on either side and perused the material records of the case. 7.Firstly, it can be seen that the allegations against the accused are that they were attempting to hatch conspiracy. Secondly, the other persons are with criminal background. As far as the allegation against the petitioner is concerned, she booked the room on the first day. The fact that she doesn't have any criminal background is also kept in mind. In view thereof, except for the statement made by defacto complainant that she booked the room on the first day, in the entire final report, there is no other material as against the petitioner. 8.Considering the same and considering the fact that the petitioner does not have any criminal background and that, there is no material pointing out that she had any connection with the other accused, I am of the view that there is no material at all to proceed as far as the present petitioner. The proceedings in SC.No.259 of 2026 on the file of the V Additional District Court, Coimbatore, shall stand quashed in so far as the petitioner/accused No. 6 is concerned.
