For the respondents : Mr. Vikas Rajput, Advocate. Ajay Mohan Goel, Judge (Oral) CMP No. 1760 of 2026 In view of the averments made in the application the same is allowed. CWP No. 1470 of 2022 2. With the consent of the parties, the case has been taken up for consideration at this stage itself. 3. By way of this writ petition, the petitioner has, inter alia, prayed for the following relief:- 1Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:4660-DB “(i) That the case of the petitioner be considered for compassionate appointment in Class-III post.” 4. Learned counsel for the petitioner has drawn the attention of the Court to the reply filed by the Corporation in general and Para-10(h) thereof in particular, which reads as under:- “10(h) That the content of Para No. 10 (h) it is submitted that the petitioner had applied for the post of clerk in the year 2019 and his name is placed at serial no. 43 of class-III list, his case will be screened on the availability of vacancy of compassionate employment quota i.e. 5% of the total vacancy on yearly basis. It is pertinent to mention here that total 4898 Nos. of posts have been sanctioned to the post of Conductor and the sufficient vacancy arises for direct recruitment on yearly basis. Accordingly 5% quota number of vacancy arise in the compassionate quota and accordingly numbers of applicants who has applied for the post of Conductor have been engaged under kith and kin policy whereas the petitioner has applied for the post of Clerk and his name is placed at Sr. No. 43 of class-III list and his name will be screened for the post of JOA(IT) on his turn and as per vacancy/seniority.” 3 2026:HHC:4660-DB 5. Learned counsel submitted that in terms of the contents of this para, the petition be disposed of with the direction that as and when the turn of the petitioner comes, needful be done on the basis of the holding made in said para of the reply. 6. Learned counsel for the respondents-Corporation, on instructions, informed the Court that now the name of the petitioner is at S.No. 63 for the reason that in between those candidates who lost their parent before the death of the parent of the petitioner but were minor at the time when their parent died and applied for compassionate appointment after they attained the age of majority and qualification, have been placed over and above the petitioner. 7. Be that as it may, as the case of the petitioner has not been rejected by the Corporation and it is only that he has to wait for his turn, this petition is disposed of with the direction that as and when the turn of the petitioner comes as per his seniority, needful be done positively. 8. The petition is disposed of in above terms. Pending miscellaneous application(s), if any, also stand disposed of 4 2026:HHC:4660-DB accordingly.
