No. 1735 of 2026 __________ Page2 of 6 ..Respondents Prayer: Writ Petition Criminal filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus or any other appropriate Writ, direction or order in the nature of a Writ, directing the respondents 1 to 2 police authorities to provide adequate police protection to the petitioner for laying the pipeline form his well to his agricultural lands through the Government Poramboke land in S.No.206/1 to 278/5 in Korattur Village, Ulundurpet Taluk, Kallakuruchi District in accordance with the permission /NOC granted by the competent authority in proceedings dated 30.11.2023 and consequently restraining the private persons from unlawfully interfering with the said work, and also permitted to pass through the public path way tractor and cattle and pass such further or others order as this Hon’ble Court may deem fit. For Petitioner: Mr.J.Muthukumaran For Respondents: Mr.R.Ganesh Kumar Counsel for Government of Tamil Nadu (Crl.Side) ORDER This Writ Petition (Criminal) has been filed seeking a direction to the respondents 1 and 2 to provide adequate police protection to the petitioner while laying the pipeline from the petitioner’s well to his agricultural lands through the Government poramboke land comprised in Survey No.206/1 to 278/5 situated at Korattur Village, Ulundurpet Taluk, Kallakurichi District. 2. The petitioner owned agricultural lands comprised in Survey Nos. 205/7, 205/8, 205/8A, 205/8B, 205/10C, 206/11B and 206/12A, 272/1B, 277/4, 277/5 situated at Korattur Village, Ulundurpet Taluk, Kallakurichi District. In order to irrigate the said lands, the petitioner depends upon a well situated in his property and has also obtained an electricity connection to draw the water from the said well. In order to irrigate the said lands, the petitioner proposed to lay a pipeline through the Government poramboke land comprised in Survey Nos.206/1 to 278/5 situated at Korattur Village, Ulundurpet Taluk, Kallakurichi District, after obtaining necessary permission from the authorities concerned. The Village Administrative Officer, viz., the fourth respondent herein, has also issued certificate dated 27.03.2025. Based on the said certificate, the third respondent, by proceedings in Na.Ka.A1/2086/2025, granted permission to the petitioner to lay the pipeline subject to the condition that he should obtain a No Objection Certificate from the Public Works Department, as the proposed pipeline was to pass through Government poramboke land. Therefore, the petitioner submitted an application before the sixth respondent seeking permission to lay the pipeline. After conducting due enquiry, the sixth respondent submitted a report before the fifth respondent. Based on the said report, the fifth respondent, by proceedings dated 30.11.2023 granted permission subject to certain conditions. However, when the petitioner attempted to lay pipeline through the Government poramboke land, some of the adjacent land owners obstructed the same and as such, the petitioner could not https://www.mhc.tn.gov.in/judis WP Crl. The learned Counsel for Government of Tamil Nadu (Criminal Side) appearing for the respondents submitted that the representation submitted by the petitioner had already been enquired and the same was closed. 5. However, it is seen that the second respondent has failed to take into consideration the permissions granted by the third respondent as well as the fifth and sixth respondents and has consequently refused to provide adequate police protection to the petitioner for laying the pipeline. 6. In view of the above, the second respondent is directed to provide adequate police protection to the petitioner to lay the pipeline from the petitioner’s well to his agricultural lands through the Government Proamboke land comprised in Survey No.206/1 to 278/5 situated at Korattur Village, Ulundurpet Taluk, Kallakurichi District, within a period of two weeks from the date of receipt of a copy of this order. If any third parties obstructed and committed any cognizable offence in the course of laying the pipeline, the second respondent is directed to register an FIR and proceed against them in accordance with law. 7.
