For Petitioners : Mr.K.Srinivasan Senior Counsel for M/s.P.Divakar For Respondents : Mr.R.Ganesh Kumar for R1 to R4 Counsel for Government of Tamil Nadu (Criminal Side) High Court of Madras O R D E R This writ petition has been filed for direction directing the first respondent to appoint G.Chandrasekaran, Special Public Prosecutor, (who was the previous Special Public Prosecutor appointed by the State Government by G.O. dated 07.07.2022 for conducting the trial SC.No.31 of 2019 on the file of I Additional District and Sessions Judge, Cuddalore) without any further delay to contest Criminal Appeal 2/ https://www.mhc.tn.gov.in/judis W.P. Crl. No.370 of 2026 Nos.543, 560, 563 of 2023 and Criminal Appeal against acquittal in Crl.A.No.1488 of 2024, based on the petitioner’s representation dated 30.12.2024. 2.The petitioners are the victims in SC.No.31 of 2019 on the file of I Additional District and Sessions Judge, Cuddalore. On their request one Mr.G.Chandrasekaran was appointed as the Special Public Prosecutor by way of G.O(D) No.945, dated 07.07.2022. Thereafter, the case ended in conviction as against some accused and ended in acquittal as against some accused. Aggrieved by the same, the convicted accused as well as the petitioners filed appeals and the appeals are pending before this Court in Criminal Appeal Nos.543, 560, 563 of 2023 and Crl.M.P.No.11561 of 2024 in Crl.A.SR.No.40575 of 2024. Therefore, the petitioners submitted representation seeking very same Public Prosecutor to appear before this Court in the above appeals. In fact, the District Collector also recommended the request made by the petitioners by appointing very same Public Prosecutor as Special Public Prosecutor before this Court by letter dated 18.03.2025. That apart, the Superintendent of Police, Cuddalore District also by letter dated 06.03.2025 recommended the request made by the petitioners for appointment of Mr.G.Chandrasekaran as 3/ https://www.mhc.tn.gov.in/judis W.P. Crl. No.370 of 2026 Special Public Prosecutor to appear in the above appeals before this Court. Both the recommendations are now pending with the first respondent. 3.In view of the above, the first respondent is directed to pass orders on the request made by the petitioner seeking appointment of Mr.G.Chandrasekaran as Special Public Prosecutor in Criminal Appeal Nos.543, 560, 563 of 2023 and Crl.M.P.No.11561 of 2024 in Crl.A.SR.No.40575 of 2024 in the light of the recommendation made by the Superintendent of Police, Cuddalore District dated 06.03.2025 and the recommendation made by the District Collector, Cuddalore District dated 18.03.2025, within a period of four weeks from the date of receipt of a copy of this order. 4.With the above direction, the writ petition is disposed of. 20.07.2026 pri Index: Yes/ No Speaking Order: Yes/ No NCC: Yes/ No 4/ https://www.mhc.tn.gov.in/judis W.P.
