The present Interlocutory Application has been instituted praying for impleading the “Commissioner of Customs, N.E.R, Shillong”, as the Respondent No. 3, in the connected Page No.# 2/2 Writ Petition being WP(C) No. 42/2026. I have perused the contentions made in the Interlocutory Application and also heard the Learned Counsel for the Parties. On a perusal of the materials coming on record, it is revealed that this Court, vide order dated 18.05.2026, passed in COP(C) No. 15/2026, had permitted the petitioner to implead the “Commissioner of Customs, N.E.R, Shillong”, as a Respondent, in the said Contempt Petition, as well as in the connected Writ Petition, being WP(C) No. 42/2026, inasmuch as the said authority is the competent authority, to comply with the directions passed by this Court, vide the order dated 09.04.2026. In view of the above position, this Court is of the considered view that the authority, now sought to be impleaded in the connected Writ Petition, is a proper and necessary party for the adjudication, involved in the proceedings of the said Writ Petition and accordingly, the present Interlocutory Application is allowed permitting the applicant to implead “The Commissioner of Customs, N.E.R, Shillong, Custom House, M.G Road, Shillong, Meghalaya – 793001”, as Respondent No. 3 in WP(C) No. 42/2026.
