JUSTICE R DEVDAS ORAL ORDER Learned Counsel or the respondent No.1/plaintiff submits that the application filed by the petitioner/ defendant No.4 under Order VII Rule 11(c) read with Section 151 of CPC was disposed of by the Trial Court by the impugned order directing the plaintiff to calculate the Court Fee as per Section 38 of the Karnataka Court Fees and Suits Valuation Act and pay the same within a period of 30 days. Thereafter, a fresh valuation slip has been filed by the plaintiff and that has been challenged by the defendant and subsequently, the defendant has filed a writ petition before this Court in W.P.No.15298/2025. - 4 - HC-KAR NC: 2026:KHC:17277 CRP No. 651 of 2023 2. The learned Counsel further submits that the application filed under Order VII Rule 11(c) having been disposed of by the Trial Court with such a direction to the plaintiff to file a fresh valuation slip, and the plaintiff having filed the fresh valuation slip subsequently, all further proceedings pursuant to the impugned order have become infructuous. 3. There is substance in the submissions made by the learned Counsel for the respondent/plaintiff. 4. This Court is of the considered opinion that having regard to the express provisions contained in Order VII Rule 11(c) of CPC, such an application filed by the defendant having regard to the facts stated hereinabove could not have been entertained by the Trial Court. Nevertheless, since subsequently a direction has been issued by the Trial Court to the plaintiff to file a fresh valuation slip and the plaintiff has filed a fresh valuation slip, all further cause of action to raise a challenge to the order has come to an end.
