The petitioner is apprehending his arrest in connection with Azadnagar P.S. Case No. 85 of 2025, registered for the offence under Sections 115(2), 126(2), 118(1), 109, 303(2), 351(2), 352 and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Jamshedpur.

Learned counsel appearing for the petitioner submits that there are case and counter case between the parties and the altercation took place at the spur of the moment. He next submits that the opinion on injury report of the injured is kept reserved and that has come in the
order of the learned Sessions Judge. He also submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-18 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submits that allegation of making assault is there.

Considering that the opinion on injury report is kept reserved and that has come in the order of the learned Sessions Judge

and further the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-18 of the petition, in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
