Learned advocate appearing for the petitioner submits that petitioner is in custody for 232 days and he has not been named in the FIR and has been falsely implicated in this case, as such the petitioner may be released on bail on any condition. Learned advocate for the State has drawn the attention of the Court to the statement of the eye-witnesses (both under Section 161 of the Cr.P.C. and Section 164 of the Cr.P.C.). I have taken into account the materials appearing against the present petitioner who engineered in gathering of all the other accused for the purposes of assaulting the deceased and others. Having regard to the complicity of the present petitioner and the stage of the case, I am not inclined to release the petitioner on bail.
2 As such, the prayer for bail of the petitioner in CRM (M) 242 of 2026 is dismissed. However, the learned trial Court is directed to expedite the process of exhausting the harsher process of law and commit the case to the Court of Sessions at the earliest. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
