ORDER This Writ Petition (Criminal) has been filed seeking a direction to the second respondent to defreeze the petitioner’s savings bank account bearing Account No.0307000101451088, as well as the fixed deposits, which were frozen pursuant to the freeze request issued by the third respondent.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner is holding a bank account bearing Account No.0307000101451088 with the second respondent. While being so, the petitioner, who is an advocate, received a sum of Rs.15,000/- from his client, viz., the defacto complainant. Thereafter, the petitioner allegedly failed to act upon the request made by the defacto complainant. Therefore, the defacto complainant lodged a complaint before the National Cyber Crime Reporting Portal, which was forwarded to the third respondent for appropriate action. That apart, the defacto complainant also lodged a complaint before the third respondent, for which a CSR was issued. Pending enquiry, the third respondent requested the second respondent to freeze the petitioner’s account and mark a lien over his account in respect of the disputed amount of Rs.15,000/-. https://www.mhc.tn.gov.in/judis

In view of the above, the second and third respondents are directed to debit a sum of Rs.15,000/- from the petitioner’s bank account and transfer the same to the account of the defacto complainant within a period of two weeks from the date of receipt of a copy of this order. Upon such transfer, the petitioner is permitted to operate the said account and the fixed deposits.
5. With the above direction, this Writ Petition (Criminal) stands
disposed of.
