WP No. 28514 of 2026 PRAYER: The Writ Petition is filed under Article 226 of the Constitution of India seeking the issuance of a Writ of Mandamus directing the 1st respondent to consider and dispose of petitioner appeal dated 06.01.2025 in accordance with law, within a stipulated time frame that may be fixed by this Court and consequently direct the 3rd respondent to transfer the patta in petitioner’s name. ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the 1st respondent to consider the petitioner's appeal dated
06.01.2025.
2. The learned counsel for the petitioner submitted that the petitioner had initially submitted an application to the third respondent seeking transfer of patta, which was rejected by an order dated 07.09.2024. Aggrieved by the same, the petitioner preferred a statutory appeal before the first respondent. However, the said appeal has not been considered till date. Challenging the inaction on the part of the first respondent, the petitioner has filed the present Writ Petition. __________ Page2 of 5 https://www.mhc.tn.gov.in/judis

Per contra, the learned Government Counsel appearing for the official respondents submitted that as against the rejection order passed by the third respondent / Tahsildar, the petitioner has an alternative remedy to file a statutory appeal before the second respondent / Revenue Divisional Officer. Instead of availing himself of such a remedy, the petitioner has directly filed an appeal before the first respondent / District Collector. Hence, he submitted that the petitioner may be directed to file a fresh appeal before the second respondent.
4. Considering the facts and circumstances of the case and the
submissions made on either side, this Court, without going into the merits of the matter, grants liberty to the petitioner to prefer a statutory appeal before the second respondent / Revenue Divisional Officer. On such appeal being filed, the second respondent / Revenue Divisional Officer is directed to consider the same and pass appropriate orders on merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of the said appeal, after issuing notice to the petitioner as well as any other interested parties and affording them an opportunity of a personal hearing. __________ Page3 of 5 https://www.mhc.tn.gov.in/judis
