3. Petitioner has challenged the order dated 02.09.2024 passed by respondent no.2 whereby recovery has been made from the payment of gratuity of petitioner amounting to Rs.1,36,298/-, and further a direction to the respondents to return the amount which was so deducted.
4. It is contended by learned Counsel for petitioner that petitioner was working with the respondent-Corporation as Senior Clerk and retired on superannuation on 31.07.2024. He was granted gratuity on retirement but a sum of Rs.1,36,298/- was deducted vide impugned order dated 02.09.2024. The petitioner is before this Court challenging the said order and direction to return the aforesaid amount.

It is contended by learned Counsel for petitioner that the controversy in this writ petition is finally settled by the Division Bench of this Court in Special Appeal No.245 of 2022 (Managing Director, Uttarakhand Transport Corporation v. Ashok Kr. Saxena) and batch, decided on 04.04.2024. It is further contended that the case of petitioner is squarely covered by the judgment passed in aforesaid special appeal.

Learned Counsel appearing for respondent-Corporation also does not dispute this fact.
7. Accordingly, the writ petition is disposed of in terms of
judgment dated 04.04.2024 passed in SPA No.245 of 2022 (Managing Director, Uttarakhand Transport Corporation v. Ashok Kr. Saxena) and batch. (Pankaj Purohit, J.)
