Petitioner has filed this writ petition seeking following reliefs: “10.1 That this Hon'ble court may kindly be pleased to issue a writ in a nature of mandamus whereby directing to the respondent no. 4 to promote the petitioner from the post of the peon to the post Assistant grade 3 against the promotional vacant post under the schedule caste female category in the office of District Education Officer Balrampur- Ramanujganj i.e. respondent no.4 by constituting departmental promotion committee. 10.2 That, this Hon'ble court may kindly please to issue a writ in nature of mandamus whereby directing to respondent no. 4 i.e. District Education officer Balrampur Education Officer to consider and decide the representation of the petitioner in relates to promotion from the post of peon to the post of Assistant grade -3 which is pending since 15.07.2025 before said authority. 10.3 Any other relief, which this Hon'ble Court may deem fit and proper, may also be passed in favour of the petitioner.” 2. Learned counsel for the petitioner submits that petitioner was appointed on compassionate basis on the post of Peon and since then she has completed 9 years of service. Accordingly, petitioner has completed minimum service of 5 years in the feeder cadre and therefore she became eligible for promotion, however, petitioner was not granted promotion to the post of Assistant Grade-III. Petitioner submitted representation before Block Education Officer on 15.07.2025 but till date it is pending consideration, and therefore, direction be issued to respondent No.4 to take decision on the pending representation at the earliest. 3 / 3 3. Learned counsel for the State submits that in view of limited prayer made by learned counsel for the petitioner to take decision on the pending representation, she is having no objection. 4. On due consideration of submissions of learned counsel for respective parties without entering into merit of case, this writ petition at this stage is disposed off directing respondent No.4 to take decision on the representation dated 15.07.2025 (Annexure P-3) in accordance with law, expeditiously, preferably within a further period of 3 months from the date of receipt of copy of this order.
