This Criminal Original Petition seeks to quash the FIR in Crime No.26 of 2019 on the file of the first respondent for the alleged offences under Sections 417, 406, 294(b), 323 & 506 (ii) of IPC on the ground of compromise between the husband and wife, as they decided to separate amicably. 2. The Hon’ble Supreme Court of India in B.S. Joshi and others -Vs- State of Haryana and Another (2003 4 SCC 675) and subsequent judgments had held that non-compoundable cases arising out of marital discord can be quashed by exercising the powers under Section 482 Cr.P.C./528 BNSS on compromise between the parties if the husband and wife join together or separate amicably. 3. Accordingly, this CRL OP No. 19635 of 2026 stands allowed. The FIR in Crime No.26 of 2019 on the file of first respondent stands quashed.
