For Petitioner: Mr.N.Kannan For Respondent: Mr.S.Yogaraja Sekar Counsel for Government of Tamil Nadu (Criminal Side) ORDER The petitioner, who was arrested and remanded to judicial custody on 05.06.2026 for the alleged offences under Sections 61(2), 306, 316 (2), 318(4) of BNS Act 2023, and, section 43 of Information Technology Act 2000, and https://www.mhc.tn.gov.in/judis CRL OP No. 20471 of 2026 __________ Page2 of 6 section 66, 66B, 66C, 66D of Information Technology ( Amendment) Act 2008, r/w 51, 63(a), 65 of Copyright Act 1957 and 6565A, 65B copyright Act ( Amendment) 2012, r/w 6AB of Cinematograph (Amendment) Act 2023 @ offence under section 306, 316(2), r/w 61(2) of BNS Act 2023, and sections 43, 66, 66 B, 66 C r/w 84 B of information Technology ( Amendment) Act 2008 and section 51, 63(a), 65 65A, 65B, of Copyright act and Section 6AB r/w section 7(1A) Cinematograph (Amendment) Act 2023 in Crime No.47 of 2026 on the file of the respondent police, seeks bail. 2. The case of the prosecution is that the petitioners/accused persons illegally accessed the film 'Jananayagan', pirated, watched and mass-circulated the same, thereby committing a criminal breach of trust and causing immense financial loss to the production company. 3. The learned counsel for the petitioner would submit that the petitioner is innocent and has been falsely implicated in this case. He would further submit that the petitioner has been in judicial custody since 05.06.2026 and is ready to abide by any conditions that may be imposed by this Court. It is further submitted that co-accused were already released on bail in Crl.O.P.No.17250 and 17788 of 2026 dated 22.07.2026. Hence, he prayed for the grant of bail. 4. The learned Government Advocate (Criminal Side) appearing for the https://www.mhc.tn.gov.in/judis CRL OP No. 20471 of 2026 __________ Page3 of 6 respondent, while opposing the grant of bail to the petitioner, reiterated the case of the prosecution and on instructions, submitted that if the petitioner is enlarged on bail, there is a likelihood of him further circulating the video footage currently available with him. 5. At this juncture, the learned counsel for the petitioner undertakes to not circulate the said video footage. 6. I have given anxious consideration to the submissions made by the learned counsel on either side. 7. Considering the submissions of the learned counsel on both sides and in view of the undertaking given by the learned counsel for the petitioner, as well as taking into account the period of incarceration undergone by the petitioner since 09.06.2026 and the fact that the co-accused have already been enlarged on bail by this Court in Crl.O.P.Nos. 17250 and 17788 of 2026 dated 22.07.2026, this Court is inclined to enlarge the petitioner on bail, subject to certain conditions. 8. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty-Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned https://www.mhc.tn.gov.in/judis CRL OP No. 20471 of 2026 __________ Page4 of 6 XI Judicial Magistrate, Saidapet, Chennai and subject to the following conditions: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders; [c] the petitioner shall not abscond either during investigation or trial; [d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283]; [f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 29-07-2026 SHL https://www.mhc.tn.gov.in/judis CRL OP No. 20471 of 2026 __________ Page5 of 6 Note: 1.
