1. This 2nd bail application under Section 483 of B.N.S.S, 2023 has been filed by the accused petitioner in connection with FIR No.296/2025 registered at Police Station- Pahari District Deeg, (Raj.) for the offences under Sections 109(1) & 3(5) of B.N.S.,

Learned counsel for the petitioner submits that initially in the first information report, there were allegations against the three persons for using firearm which led to injuries to the three children. However, the police after completion of investigation has already submitted charge-sheet only against the present accused- petitioner. Learned counsel further submits that it is not specific in the first information report whether the firearm injuries is caused by the present petitioner or not. Learned counsel also submits that the accused-petitioner is in custody since 01.12.2025 and with the

3. Learned Public Prosecutor vehemently opposed this 2nd bail application.

Learned counsel for the complainant verifies the facts of compromise in between the parties.
5. Taking into consideration the overall facts and circumstances of the case and more particularly the accused-petitioner is in custody since 01.12.2025, this court without expressing any opinion on the merits or demerits of the case, deems just and proper to enlarge the petitioner on bail.
6. Accordingly, this 2nd bail application is allowed and it is
directed that accused-petitioner shall be released on bail provided that he furnishes a personal bond in the sum of Rs. 1,00,000/- together with two sureties in the sum of Rs. 50,000/- each to the satisfaction of the trial Court with the stipulation that he shall appear before that Court and any Court to which the matter be transferred, on all subsequent dates of hearing and as and when called upon to do so.
