Heard learned counsel for the Petitioner as well as learned counsel for the State. Perused the application as well as the prayer made therein. 3. By filing the present writ petition the Petitioner falls in question the validity and legality of order dated 17.01.2026 at Annexure-9 passed by the Director, Higher Education, Odisha- Opposite Party No.2 to the writ petition. 4. On perusal of the impugned order dated 17.01.2026, it appears that the same is an appealable order. 5. On the prayer of the learned counsel for the Petitioner, he is permitted to withdraw this writ petition with liberty to approach the appellate court by filing an appeal along with an application for condonation of delay, if any. In the event any such application is Page 2 of 2. filed for condonation of delay within two weeks, the same shall be considered liberally and the delay, if any, be condoned and the appeal be entertained and considered on merit. Further, liberty is granted to the Petitioner to move any interim application which shall be considered in accordance with law by the appellate authority. 6. Accordingly, the writ petition stands disposed of as withdrawn with liberty as prayed for.
