Counsel for State of TN(crl.side) for R1 M/s.D.Karthikraja for R3 * * * * * ORDER The present petition has been filed by the accused persons in Spl.S.C.No. 207 of 2025, on the file of the Special Court for exclusive trail of cases under POCSO Act, Dindigul, seeking to quash the charge sheet wherein they are charged with the offences under Sections 9 and 10 of the Child Marriage Act, 2006 and Sections 5(l), 5(j)(ii), 6, 17 and 6(1) of the POCSO Act. 2. The date of birth of the victim is 03.05.2008 and she had attained majority on 03.05.2026. On attaining majority, she had married the first accused on 03.06.2026 and the marriage has been registered before the Sub Registrar, Nagal Nayakkanpatti, Dindigul, on 29.06.2026. 3. The victim girl was present before this Court on 24.06.2026 and submitted that she had married the first accused and requested the Court for quashing of the charge sheet. 4. Today, the marriage certificate has been produced and this Court has perused the original certificate. 5. The defacto complainant is present in-person before this Court today and she acknowledges the fact that she had agreed for quashing of the charge sheet. 6. Considering the above said facts, charge sheet in Spl.S.C.No.207 of 2025, on the file of the Special Court for exclusive trail of cases under POCSO Act, Dindigul, is hereby quashed. 7. Accordingly, this Criminal Original Petition stands allowed. The joint compromise memo shall form part and parcel of the order.
