Sahay, APP --- 04/09.04.2026 Heard the learned counsel appearing on behalf of the parties. 2. Learned counsel for the petitioner submits that the petitioner is in custody since 19.07.2024 in connection with Chitra P.S. Case No.59 of 2024, arising out of S.T. No.374/2024, registered under Sections 103(1), 238(a), 61(2), 3 (5) of B.N.S, 2023, and charge sheet has been submitted against the petitioner under Section 103, 238 (a) now pending in the court of learned Additional Sessions Judge – I, Madhupur (Deoghar). 3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case only for the reason that the petitioner happens to be the husband of the deceased. 4. The learned counsel has submitted that the petitioner is in custody since 19.07.2024 and he has been made accused only on account of suspicion. He has also submitted that the marriage between the petitioner and the victim was more than 25 years. 5. The learned counsel for the State has opposed the prayer and submitted that 4 witnesses have already been examined. 6. After hearing the learned counsels for the petitioner and upon going through the impugned order, it appears that the trial is in progress and as on 29.01.2026, 4 witnesses out of 11 were already examined. The petitioner is the named accused in the F.I.R and as per the F.I.R., It has been alleged that there was matrimonial discord between the petitioner and the victim. Since the trial is in progress and the petitioner is named accused in the F.I.R., this Court is not inclined 2026:JHHC:10179 2 to enlarge the petitioner on bail. 7. The State is directed to ensure that the witnesses are promptly produced before the court. 8. The learned counsel for the State is directed to communicate this order to the Director, Prosecution and also the Superintendent of Police of the concerned district to ensure compliance. 9.
