ORDER This writ petition has been filed seeking a direction to respondents 1 to 4 to conduct an enquiry, ensure the petitioner's turn to conduct the temple festival of Sri Mupudadi Amman and Sri Sandhanamari Amman Temples situated at Pattapillaiputhur from 03.08.2016 to 05.08.2026 and consider and dispose of the petitioner's representation dated 16.05.2026. 2/6 https://www.mhc.tn.gov.in/judis

The learned counsel for the petitioner submitted that pursuant to the resolution arrived at between the petitioner's faction and the sixth respondent's faction in the year 1998, it was decided that both factions would conduct the temple festival in alternate years and all members of the respective factions would participate in the festival. The said arrangement has been followed for several years. Since the sixth respondent's faction conducted the festival during the previous year, it is the turn of the petitioner's faction to conduct the festival during the present year. In this regard, the petitioner submitted a representation dated 16.05.2026 to the competent authorities seeking necessary permission and police protection. However, the same has not been considered so far. Hence, the present writ petition has been filed. 3. The learned counsel for the sixth respondent submitted that though such an arrangement continued for several years, it was resolved among all the parties during the previous year that the temple festival would be conducted jointly by both factions and now the festival would be conducted by both factions this year. 3/6 https://www.mhc.tn.gov.in/judis
4. The learned Government Advocate, on instructions, submitted that the submission made by the learned counsel for the sixth respondent is incorrect. She further submitted that the sixth respondent's faction conducted the temple festival during the previous year and the present year is the turn of the petitioner’s faction to conduct the festival. 5. In view of the respective submissions made by the learned counsel appearing for the parties, this Court, taking note of the fact that the sixth respondent's faction had already conducted the temple festival in the year 2025, permits the petitioner's faction to conduct the temple festival of Sri Mupudadi Amman and Sri Sandhanamari Amman Temples situated at Pattapillaiputhur from 03.08.2026 to 05.08.2026.
Hence, the respondent police are directed to issue notice to the petitioner's faction and the sixth respondent's faction and make it clear that the petitioner's faction shall conduct the temple festival and all the villagers, including the members of the sixth respondent's faction, shall be permitted to participate in the temple festival without any disturbance.However, in the present year, the temple festival shall be conducted by the petitioner's 4/6 https://www.mhc.tn.gov.in/judis
faction and in the subsequent year, by the sixth respondent's faction. The said arrangement shall continue in terms of the resolution arrived at between the parties in the year 1998. 6.
