The petitioner is apprehending his arrest in connection with Sahibganj Rail PS Case No.22 of 2025, corresponding to Rly. G.R. Case No.39 of 2025, for offence registered under section 317(5) of BNS, 2023, pending before learned Railway Judicial Magistrate at Sahibganj. 3. Learned counsel for the petitioner submits that on the basis of confessional statement of the apprehended co-accused the name of the petitioner has come and the only allegation is there against the petitioner that the lady was going to sell the stolen mobile to this petitioner. He also submits that the petitioner is having no criminal antecedent as disclosed in para-17. He next submits that the co-accused in identical situation has been granted anticipatory bail in ABA No.7382 of 2025. 4. Learned State counsel opposes prayer and submits that the name of the petitioner has been taken by the apprehended co-accused. 5. Considering that only allegation made against the petitioner is that said lady was going to sell stolen mobile to this petitioner and the co-accused has been granted anticipatory bail as aforesaid, and in that view of the matter, the petitioner, above named, is, hereby, directed to surrender before learned court within two weeks from today, and learned court shall release the petitioner, above named, on such terms and conditions as well as sureties, as learned court may deem fit and proper. 6.
