M/L91 06.04.2026 Bpg. C.R.M. (DB) 2592 of 2024 In Re: An application for cancellation of bail under Section 439 (2) of the Code of Criminal Procedure, 1973 and corresponding to Section 483(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Sagar Police Station FIR No.71 of 2024 dated 03.04.2024 under Sections 344/376(2)(n)/354(c)/506 of the Indian Penal Code and Sections 67/67A of Information Technology Act; XYZ Versus State of West Bengal & Anr. Mr. Saibal Bapuli Mr. Mujibar Ali Naskar. …for the State. Records of the case reflect that the subject matter of challenge relates to the order dated 17.05.2024 wherein the accused/opposite party no.2 was granted bail. More than 1 year 10 months have passed since the bail was granted. The allegations made by the petitioner is that after being released on bail the petitioner was subjected to dire consequences by the accused on 08.07.2024 for which the petitioner informed the Sagar Police Station. Learned advocate for the State is present. Having considered the time period which has passed as also the fact that State has been unable to apprise this Court in respect of the authenticity of the said accused, I am not inclined to interfere with the order of bail which was passed on 17.05.2024. However, if there are further accusations or any cognizable offence 2 is committed at the behest of the accused/opposite party no.2, the same be brought to the notice of the jurisdictional court. The jurisdictional court would, if required, impose stringent conditions or cancel the bail as it deems fit and proper. Mr. Soumik Ganguli, learned advocate, submits that he has not been engaged in this matter on behalf of the petitioner but his name has been inadvertently recorded in the earlier orders. The same be deemed to be deleted. With the aforesaid observations, CRM(DB)2592 of 2024 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
