For Petitioner : Mr.G.Gangai Amaran ORDER The Civil Revision Petition is filed challenging the docket order dated 09.07.2026 passed by the trial Court. 2.It is seen from the typed set of papers that the petitioner/plaintiff filed the suit seeking a declaration that the 2/6 https://www.mhc.tn.gov.in/judis C.M.P.(MD)No.9637 of 2026 bifurcation of the Vellore, Dharmapuri, Coimbatore and Tiruppur territories from the North Tamil Conference of the Seventh-day Adventist Church, having its headquarters at Tiruchirappalli, without amending the bye-laws of the North Tamil Conference, is null and void, and for a consequential relief of mandatory injunction directing the defendants to render true and proper accounts. 3.Pending the suit, the petitioner filed an interlocutory application seeking an interim injunction restraining the respondents from conducting the 8th Constituency Session of the North Tamil Conference. 4.When the matter was taken up on 09.07.2026, since the learned trial Judge was on leave, the matter was adjourned to 10.08.2026. Aggrieved by the said adjournment, the petitioner has filed the present Civil Revision Petition. 5.The learned counsel for the petitioner submitted that, without considering the urgency involved in the interim application, the matter was mechanically adjourned to 10.08.2026. If the interlocutory application is not taken up at the earliest, the relief sought therein would become infructuous. 3/6 https://www.mhc.tn.gov.in/judis C.M.P.(MD)No.9637 of 2026 6.An order merely adjourning a matter to another date cannot ordinarily be made the subject matter of a revision, as no rights of the parties are adjudicated by such an order. If the petitioner is of the view that there is urgency in the matter and that the adjournment would render the interlocutory application infructuous, it is always open to the petitioner to file an appropriate application before the trial Court seeking advancement of the hearing. Without adopting such a course, the petitioner cannot invoke the supervisory jurisdiction of this Court under Article 227 of the Constitution of India. Therefore, the Civil Revision Petition itself is not maintainable. In view of the same, this Court is not inclined to entertain the revision. 7.Accordingly, the Civil Miscellaneous Petition is dismissed and the Civil Revision Petition is rejected at the S.R stage itself as not maintainable.
