For Petitioner : Mr.A.Subramanian For Respondents : Mr.D.Venkatesh Counsel for State of Tamil Nadu O R D E R [Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] This Habeas Corpus Petition is filed to direct the respondents to produce the person or body of the detenu by name Ponmathumitha D/o.Subburaj, Female, aged about 17 years, before this Court and handover the custody. 2. Alleging that her minor daughter aged about 17 years(born on 03.08.2002) is missing from 12.07.2026 and that the respondents have not taken any steps to secure her or find her the whereabouts, despite the registration of a case in Crime No.332 of 2026 under the caption “girl missing”, the petitioner has come up before this Court by filing this Habeus Corpus Petition. 3. Mr.D.Venkatesh, learned Counsel for the State of Tamil Nadu appearing for the respondent police would submit that the petitioner has given a complaint that her daughter, aged about 17 years went missing from 12.07.2026. Based on the complaint given by the petitioner, a case in crime No.332 of 2026 was registered and during investigation, the minor girl was secured at Coimbatore from the company of one of her friend namely, Suja and the minor girl has been produced before this Court. 5. We enquired the alleged missing person/minor girl. She submitted that her mother suspecting that she was having an affair with one Gautham, who is from the nearby village used to torture her. Unable to bear the torture she had left her home on her own and went to Coimbatore along with her friend, i.e.,Suja.
She submitted that she is not in the illegal custody of anybody. When we enquired her as to whether she is ready to go along with her mother, she expressing her apprehension that she will be harasssed by her mother submitted that she is not ready to go with her mother. Mr.D.Venkatesh, learned counsel for the State of Tamil Nadu submitted since missing person does not prefer to go with her mother, she will be kept in the home, namely, Sakthi Vidiyal Home, Muthupatti, Madurai City. 7. The petitioner is also present before this Court. We enquired her. She submitted that if her daughter is not willing to jin, she may stay in the home and continue her studies. 8. Taking into consideration the fact that the missing person is to attain majority in few days, we direct the 2nd respondent to keep her in the above said home. 9.
